Welcome to PAS – Port Agency Services Sri Lanka. By engaging our services, you agree to the following Terms & Conditions which govern all transactions, operations, and interactions between PAS and its clients.
1. Scope of Services
PAS provides port agency and related maritime services, including but not limited to vessel husbandry, customs clearance, crew handling, bunkering coordination, cargo supervision, and emergency support at ports within Sri Lanka.
2. Client Responsibilities
- Clients must provide accurate, complete, and timely information required for vessel clearance, operations, and documentation.
- All necessary permits, certificates, and authorizations must be arranged and supplied where required by law.
- Clients remain responsible for compliance with flag state, port state, and international maritime regulations.
3. Fees, Disbursements & Payments
- Proforma Disbursement Accounts (PDA) will be issued before the vessel call.
- Final Disbursement Accounts (FDA) will be submitted after completion of services.
- All invoices must be settled within [X days, e.g., 15/30 days] from the invoice date, unless otherwise agreed in writing.
- Delayed payments may be subject to interest charges.
4. Liability & Indemnity
- PAS acts as an agent on behalf of the client and shall not be liable for losses, damages, delays, or costs arising from third-party service providers, port authorities, customs, or other government bodies.
- Clients agree to indemnify PAS against any claims, penalties, or liabilities resulting from incorrect instructions, documentation, or non-compliance.
- PAS is not liable for force majeure events, including strikes, natural disasters, or unforeseen government restrictions.
5. Insurance
Clients are responsible for ensuring that vessels, crews, and cargo are adequately insured. PAS does not provide insurance coverage for client operations or liabilities unless specifically agreed in writing.
6. Confidentiality
PAS respects client confidentiality. All operational, financial, and commercial information shared with PAS will be treated as confidential, except where disclosure is required by law or regulation.
7. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by the laws of Sri Lanka. Any disputes arising out of or in connection with PAS services shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
8. Amendments
PAS reserves the right to amend or update these Terms & Conditions at any time. Updated versions will be published on our official website.
